ECP has no authority to act against KP CM: PHC

Barring the Election Commission of Pakistan from taking any action against the Chief Minister Khyber Pakhtunkhwa, the Peshawar High Court on Thursday ruled that the Electoral watchdog does not have the authority to act against the Chief Minister of Khyber Pakhtunkhwa Ali Amin Gandapur.

In response to Chief Minister Gandapur’s petition challenging the ECP’s disqualification notice, the high court has issued a written order. The court cited the interpretation of clause 62-1(f) by the Supreme Court, particularly in the Nawaz Sharif case.

A two-member bench of the Peshawar High Court comprising Justice Ijaz Anwar and Justice Waqar Ahmed had on Wednesday suspended ECP disqualification proceedings against KP Chief Minister Ali Amin Gandapur of the PTI. During the proceedings the court had remarked that after the Supreme Court’s verdict, no institution has been authorized to declare someone ‘truthful’ and ‘trustworthy’.
