Shakil Shaikh decides to sue PCB, others over malicious inquiry

ISLAMABAD – Shaikh Shaikh, former member of the Board of Governors (BoG) of PCB, has rejected reports of being banned by the board over financial irregularities.

His response comes after reports claimed that he has been banned for lift on the recommendations of the committee formed about five months back by the PCB to probe the charges of financial irregularities against him.

Shakil Shaikh shared his response on social media platform X, saying PCB instituted suit/case on frivolous grounds against Diamond Cricket Club and him during former chairman Ehsan Mani’s tenure in October 2020. He said this suit proceeded for around four years. However, PCB remained unsuccessful in substantiating its case against DCC, Shaki Shaikh and others.

“This matter was investigated internally within PCB which finds that the case of the PCB is frivolous and baseless and also the Civil Court of Islamabad dismissed the case of the PCB at time when Zaka Ashraf was the head of PCB Management Committee. Shakil Shaikh and others have already been ‘EXONERATED’ from all baseless allegations not only by the PCB internal inquiry conducted by two high profile directors but also by the Civil Court of  Islamabad in July 2023. Till date PCB have not challenged the decision of Court,” he wrote.

“Now, a politically motivated inquiry under Zaka Ashraf was initiated in PCB on same allegations, issues and similar subject matters wherein ex parte proceedings were conducted without hearing Shakil Shaikh and others. It is averred that as per the law of the land and the Principle of “Res-Judicata” the matter/case once decided by a court of law cannot be reopened/re-adjudicated, hence, the present inquiry by it self is illegal and void ab initio,” he added.

Furthermore, the inquiry and its findings tantamount to “double jeopardy” which provides that a person cannot suffered twice for the same cause/matter.

Neither copy of the alleged complaint filed by a PCB-certified corrupt Amir Nawab and one Junaid Akhtar nor any other documents or authority or legality of this inquiry was given to the defendants. This ex-parte inquiry was conducted despite the fact that PCB case has been dismissed and Diamond CC, Shakil Shaikh and other defendants have been ‘EXONERATED’ by the Civil Court, Islamabad.

In another post, Shaikh said he intended to serve legal notice on PCB, Zaka Ashraf, inquiry committee and witnesses over running this malicious campaign.
