IN a significant and bold move, South Africa has filed a case at the International Court of Justice (ICJ) against Israel’s genocide acts in Gaza. This is a commendable step in stark contrast to the stance of some powerful nations that continue to extend support to Israel, further escalating suffering of the Palestinian people.
South Africa’s application emphasises that Israel is acting with specific intent to destroy Palestinians in Gaza, constituting a broader assault on the Palestinian national, racial and ethnic group. This courageous move by South Africa demonstrates a commitment to justice and human rights. The country has a long-standing history of supporting the Palestinian cause for statehood, drawing parallels between plight of Palestinians and the struggles of Black majority in South Africa during repressive apartheid era. While powerful nations continue to turn a blind eye and actively support Israel, South Africa’s initiative serves as a reminder that principles of justice and humanity must prevail over political considerations. The UN Security Council’s failure to pass a resolution for a ceasefire and cessation of hostilities is regrettable. Now, the ICJ must swiftly act given the worsening situation in Gaza, where people face hunger, starvation, lack of water and fuel supplies and a dire shortage of medical care.
It is crucial to acknowledge that while decisions by the ICJ are final, the court lacks means to enforce its rulings. In this case, there is a genuine concern that Israel will not comply with the ICJ’s decision. As suffering of Palestinians intensifies, with a rising death toll including innocent children, the Muslim countries and their leaders should step forward, raising their voices at international forums, including the UN. For lasting peace and stability in the Middle East, the United States must assume the role of an honest moderator. The international community, especially those with capacity to effect change, must unite to ensure that rights of the Palestinian people are upheld. South Africa’s stance is a beacon of hope, reminding the world that standing against oppression is a duty that transcends borders.
