IIOJK HC reserves decision on plea seeking return of fake encounter victim’s body

In Indian illegally occupied Jammu and Kashmir, the High Court has reserved its decision on a plea by the father of Hyderpora fake encounter victim seeking return of the body of his son for decent burial.

A bench of Justice Sanjeev Kumar reserved the verdict after hearing Muhammad Amir’s father Muhammad Latief Magrey through his lawyer Deepika Singh Rajawat, and respondents Indian Ministry of Home Affairs (MHA) and IIOJK authorities.

Muhammad Amir Magray along with three other civilians was martyred by Indian troops on November 15 last year in a fake encounter in Hyderpora area of Srinagar.

On January 12 this year, the Court had issued the notice to India’s MHA and the IIOJK authorities for response to the plea following the submissions by Advocate Rajawat that delay in handing over the body would traumatize the family members mentally. Delay, she said, was not feasible medically also.

Referring to the return of the bodies of two others, a building owner and a doctor with whom Amir was working as an office peon, the petitioner pleaded the court to direct the MHA, IIOJK authorities and Director General of Police to hand over his son’s body to the family.

The petitioner expressed his wish to bury his son close to his house in Ramban district in the Jammu region.—KMS
