Karachi court rejects bail for suspect in Karsaz accident case

Court has denied bail to a female suspect involved in a fatal accident at Karsaz, despite the victims’ families having pardoned her. The bail application was turned down by Additional District and Sessions Judge (East) Shahid Ali Memon on Friday. This decision comes a week after the heirs of the victims submitted an affidavit to the court stating their forgiveness.

The affidavit expressed that the accident was unintentional and they had pardoned the suspect for “Allah’s sake, who is the kindest and most merciful.” Earlier, the bail plea was also rejected by Judicial Magistrate (East) Muhammad Raza Ansari in the same case.

The court’s decision highlighted concerns over the suspect’s potential flight risk, citing her possession of a British passport and driving license. The order noted, “The suspect is likely to leave the country if granted bail.”

The court emphasized that drug users involved in such cases generally do not merit bail and noted that the relevant laws and evidence presented were not sufficient to justify granting bail. The suspect’s lawyer argued that the case should fall under the Control of Narcotic Substances (CNS) Act rather than the Anti-Narcotics Act, which would impose a lesser penalty of one year’s imprisonment and a fine. However, this argument did not sway the court’s decision. The case involves accusations of driving under the influence and a subsequent accident in which two people were killed and two others injured.

Despite the pardon from the victims’ families, the court maintained that the severity of the case and the potential for the suspect to flee influenced its decision to deny bail.
