ISLAMABAD – Supreme Court Judge Justice Musarrat Hilali has declined her proposed appointment as a judge of the newly established Federal Constitutional Court, citing health-related reasons.
The sources said that Justice Hilali’s name was under active consideration for the position, but she formally conveyed that she would be unable to take up the role due to ongoing health issues. Her bench had recently been delisted for the same reason.
The development comes a day after Parliament approved the 27th Constitutional Amendment, which paved the way for the creation of the Federal Constitutional Court.
Following the amendment, President Asif Ali Zardari approved the appointment of Justice Aminuddin as the court’s first Chief Justice on the recommendation of Prime Minister Shehbaz Sharif.
Earlier, in a significant judicial development, two senior Supreme Court judges — Justice Mansoor Ali Shah and Justice Athar Minallah — resigned from their positions in protest against the amendment. Their resignations have been submitted to the President for approval.
