ISLAMABAD – Former PTI leader and Member of National Assembly (MNA) Sher Afzal Khan Marwat has filed a petition in the Federal Constitutional Court seeking the restoration of Ali Amin Gandapur as Chief Minister of Khyber Pakhtunkhwa, challenging recent political and administrative developments in the province.
In his petition, Sher Afzal Marwat argued that Gandapur’s resignation was not voluntary and was allegedly taken under pressure. He maintained that the resignation therefore holds no legal validity and should be declared void by the court.
He further contended that the removal and subsequent administrative actions were unconstitutional, urging the court to reverse all related notifications, including the appointment of Sohail Afridi as the new Chief Minister of Khyber Pakhtunkhwa.
Marwat also requested the court to restore Gandapur to his previous position and invalidate all decisions taken following what he described as unlawful procedures.
The petition indirectly referred to decisions influenced by the jailed PTI founder Imran Khan, who has been in custody since August 2023 in multiple cases related to corruption and other charges.
Reacting to the development, Gandapur distanced himself from the petition, stating that he has no involvement in any legal proceedings and that he complied with party instructions to resign from the office.
Meanwhile, PTI Chairman Barrister Gohar Ali Khan rejected the petition, terming it politically motivated and asserting that the appointment of Sohail Afridi was made with the approval of the party leadership and cannot be reversed.
