ISLAMABAD – Former Director General of Inter-Services Intelligence (DG ISI) Lieutenant General (retd) Faiz Hameed on Tuesday filed an appeal against the sentence awarded to him by a military court.
His counsel, Mian Ali Ashfaq, confirmed that an appeal against the punishment handed down by the military court was filed on December 27. However, he declined to share further details regarding the grounds of the appeal.
It is pertinent to recall that a Field General Court Martial had sentenced Lt Gen (retd) Faiz Hameed to 14 years of rigorous imprisonment after finding him guilty of violating the Official Secrets Act, misuse of authority, and contraventions of the Pakistan Army Act.
Earlier, Director General Inter-Services Public Relations (DG ISPR) Lieutenant General Ahmed Sharif Chaudhry had briefed the media about the verdict during a press conference on December 11. He stated that investigations against Faiz Hameed were initiated under the Pakistan Army Act on August 12, 2024, and after a 15-month inquiry process, the military court awarded the sentence.
Under Section 133-B of the Pakistan Army Act, the convicted officer was entitled to file an appeal against the decision of the Field General Court Martial within 40 days of the announcement of the verdict.
According to the law, the appeal against a military court sentence is reviewed by a Court of Appeals constituted by the Army Chief.
Following the review, the army chief has the authority to accept the appeal, reject it, suspend the sentence or issue orders for modification of the punishment.
Sources said the appeal contended that the sentence awarded to Faiz Hameed is unlawful and based on flawed grounds. It further submitted that the prosecution failed to substantiate its case and that the principles of a fair and transparent trial were not duly observed during the proceedings.
