LHC declares plea non-maintainable

The Lahore High Court on Tuesday turned down the request to restore the position of former Prime Minister Mian Muhammad Nawaz Sharif as PML (N) head, the court upheld the objection of the Registrar’s Office that the application was not admissible.

Justice Ali Baqranjafi heard advocate’s application as an objection, the applicant lawyer Muhammad Afaq appeared and took the position that the Election Commission disqualified Imran Khan from the Mianwali Constituency, despite the disqualification, he was not removed from the post of party chairman. While Nawaz Sharif was removed from the office of the party president, the lawyer said that the petition against Imran Khan’s disqualification is pending in the five-member bench, this case should also be sent to the same bench, Justice Ali Baqir Najafi said that what you have requested should be read. The lawyer said that Nawaz Sharif should be restored as party president, the second request is that action should be taken against Imran Khan, Sheikh Rashid and Siraj ul Haq under Article 63.

The distinguished judge said to read the objection of the registrar office, the lawyer said that the objection is that Nawaz Sharif was disqualified by the Supreme Court, the application can be filed there, Justice Ali Baqranjafi remarked that the Supreme Court has already given decisions in two similar cases.

The lawyer then requested that the objection petition be given to a five-member larger bench. The learned judge said that first the objection of the registrar’s office should be removed on this petition and it would be appropriate for you to file an amendment petition in this regard.
