Kashmir not part of India

 

INDIA’S stance on Jammu and Kashmir dispute remains a stark example of its disregard for both international law and the fundamental principle of self-determination. The recent assertion by India’s Permanent Representative to the UN, that Jammu and Kashmir is an “integral and inalienable” part of India, contradicts the realities on the ground and dismisses the longstanding aspirations of the Kashmiri people. Such claims, devoid of factual basis, cannot alter the undeniable truths of the situation.

The fact of the matter is that Jammu and Kashmir is a disputed territory under international law, a fact India itself acknowledged when it initially brought the issue before the United Nations. The UN intervention in 1948 resulted in the promise of a plebiscite, allowing the Kashmiri people to decide their future. Yet, more than seven decades later, this commitment remains unmet, with India failing to honour its obligations. Instead, India has escalated its military presence in the region, implemented draconian measures to stifle dissent and imposed severe restrictions on the basic freedoms of Kashmiris. These actions stand in direct violation of both human rights and the international community’s expectations for a peaceful resolution. The Kashmiri people have continuously expressed their desire for self-determination. Despite facing systemic oppression and violence, the spirit of freedom remains unbroken among them. This resilience is a testament to their unwavering determination to decide their own fate. Pakistan has repeatedly called for a peaceful resolution of the Kashmir dispute, in line with the UN Security Council’s resolutions. However, India’s refusal to engage in meaningful dialogue and its persistent policy of military occupation continue to obstruct any potential path toward peace. India’s approach not only undermines regional stability but also perpetuates the cycle of violence and injustice. It is essential for the international community to play its role and fulfill the promises made with the Kashmiri people. The right to self-determination, as enshrined in the United Nations Charter, cannot be ignored. The global community while shunning silence must hold India accountable and demand the implementation of UN Security Council resolutions that call for a free and fair plebiscite. Only through such an approach can the aspirations of the Kashmiri people be fulfilled and lasting peace achieved in the region.
