The Islamabad High Court on Wednesday restrained the federal government from appointing Chairperson Higher Education Commission and issued notices on the matter to the federation with directions to relist the case on June 08.
The IHC Chief Justice Athar Minallah heard the petition filed by some educationists and civil society challenging the Higher Education Commission (Ammended) Ordinence 2021, and restoration of Dr Tariq Banuri as the HEC chairperson.
The petitioners counsel argued “The government is abolishing the autonomy of institution through ordinances.
If you look at the ordinance, only one person Tariq Banuri is affected by it and how it could be that an ordinance is only for a particular person, and the removal of HEC chairperson without following the removal procedure laid down in Section 6(6), Ordinance, 2002.
He further argued that the tenure of the HEC Chairperson has also been reduced, and the language used in the ordinance was for specific purposes only, he argued.
