The federal government on Wednesday approached the Supreme Court with a review petition against its order regarding the transfer of PTI founder Imran Khan from Adiala Jail to Shifa International Hospital for medical treatment.
Islamabad chief commissioner submitted the petition through the advocate general for the Islamabad Capital Territory (ICT).
Yesterday, the Supreme Court directed jail authorities to move the former prime minister to the private hospital within two days.
The government argued that the Supreme Court’s August 18 interim order went beyond its lawful jurisdiction and contained an error that warranted reconsideration.
The petition maintained that a relevant statutory provision had not been taken into account when the order was issued. It argued that consideration of the provision would have prevented the court from issuing the directive and therefore sought a review of the decision.
The development followed remarks by Law Minister Azam Nazeer Tarar on Tuesday that the federal government would challenge the court’s decision to transfer Imran Khan to a private medical facility.
The 73-year-old PTI founder has been incarcerated since August 2023 after being convicted in a number of cases that he and his party have described as politically motivated. He has remained involved in several legal proceedings since being removed from office through a no-confidence vote in April 2022.
