THE Council of Islamic Ideology (CII), a constitutional body entrusted with advising the government and parliament on Islamic matters, has rightly called for the establishment of special courts to try cases of mob vigilantism. The recommendation comes in the wake of the disturbing events in Sargodha, where an angry mob unleashed violence fuelled by rumours of the desecration of the Holy Quran. While condemning such acts unequivocally, the CII has emphasized the need for a robust legal framework to address instances of mob justice effectively.

This call for specialized courts is not without precedence. In the past also, the CII has advocated for similar measures, notably following incidents like the Jaranwala episode and the tragic lynching of Priyantha Kumara Diyawadanaa, a Sri Lankan national in Sialkot. These instances serve as stark reminders of the grave consequences of unchecked mob violence and the urgency of instituting mechanisms to prevent its recurrence. Specialized courts dedicated to trying cases of mob vigilantism serve multiple purposes. Firstly, they demonstrate the state’s commitment to upholding the rule of law and ensuring justice for all citizens. Secondly, they provide a forum where cases can be adjudicated swiftly and impartially, thereby restoring faith in the judicial system. Thirdly, they serve as a deterrent against future acts of mob violence, signalling that perpetrators will be held accountable for their actions. Moreover, it is essential to underscore the importance of bringing those responsible for desecration, irrespective of their religious or social affiliations, to justice through legal means. Upholding the sanctity of religious texts and figures is crucial, but it must be done within the framework of the law, with due process and fairness. The proposal put forth by the CII must not be treated as a mere suggestion but as a pressing imperative. The government and parliament must act to heed the counsel of the CII and enact measures to establish these special courts without delay.
