Letters of Administration and Succession Certificates Act, 2020

The Letters of Administration and Suc cession Certificates Act, 2020, (Act No. VI of 2020) has been enforced for providing an easier way to obtain the letter of administration and succession certificate without going to the courts through speedy and shorten process. Undoubtedly, the purpose of publishing such legal content is to make the public aware of their rights and duties and make them responsible citizen. Under the said Act, the National Database and Registration Authority (NADRA) may issue the letters of administration and succession certificates to the legal heirs of a deceased person.

What is Letter of Administration and Succession Certificate? The succession certificate or letter of administration is a document issued to the legal heirs of a deceased to establish their ownership as to movable and immoveable assets of deceased person.Procedure is given hereunder.
Step 1:
Filling of Application. The legal heirs may apply in writing in the notified Succession Facilitation Units established by the NADRA, in whose jurisdiction,-
(a) The deceased was residing at the time of death: or, (b) Where any property or asset of deceased is located.

Step 2:
Provision of Required Documents? With the application, all the details of legal heirs along with copies of their CNICs, death certificate of the deceased and details of his moveable/immovable properties/assets are to be enclosed.

Step 3:
Notice of Public by the NADRA. After receiving the application, the NADRA will issue notice for general public in the local newspaper and on its web-sites. In case of any objection upon the application of legal heirs, the objections may be filed before the Authority in office of the NADRA.

Step 4:
Bio-matric Verification of Legal Heirs. If no one raises any objection to the application, then the NADRA will obtain bio-matric verification of legal heirs. Letter of administration or succession certificate will be issued after verification of record.

Step 5:
Issuance of Denial Certificate any objection is received against the application, the NADRA may issue denial certificate to the applicant with instructions to avail remedy from the relevant court.

Fee: The NADRA may charge the prescribed fees for its services:
• Rs.20,000/-, if value of property is more than Rs. 100,000/-. • Rs. 10,000/-, if value of property is less than Rs. 100,000/-. Facilitation Units: • NADRA Mega Centre, Khyber Plaza, Blue Area, Islamabad. • Details of regional facilitation units, situated in Punjab, Sindh and Khyber Pakhtunkhwa, are available at the NADRA website, i.e., www.nadra.gov.pk.
