Article 99 of the United Nations Charter and Trilateral Dialogue

United Nation was built on the framework to bring peace around the world. As its article 99 states that “The Secretary-General may bring to the attention of the Security Council any matter which in his opinion may threaten the maintenance of international peace and security.” So, in order to end the war once and for all, the Secretary General of the United Nations to use Article 99 of the United Nations Charter to convene talks between the governments of India and Pakistan and the legitimate leadership of the people of Jammu & Kashmir.

The memorandum also states that the people of Jammu and Kashmir appreciate the fundamental stance taken by the UN, which you expressed on August 8, 2019, that the Kashmir issue must be handled in accordance with the UN Charter and any relevant UN Security Council resolutions. Therefore, UN as a peace provoker must compel India to carry out its promises in order to guarantee the restoration of democracy and social justice.

Moreover, the document explains that as the 77th United Nations General Assembly begins, the globe has changed significantly in recent years. East Timor, Namibia, Southern Sudan, and other countries got freedom and peace due to UN’s comprehensive involvement in peace restoration. Millions of people who longed for self-determination are now free with the mediation of UN. Unfortunately, Kashmir as a small forgotten land continues to call out for the United Nations to step in as the rest of the world rejoices and celebrates the freedoms of these nations. It is the disputed portion of Kashmir that India now occupies.

“For over 75 years, the people of Jammu & Kashmir have been peacefully struggling for their right to self-determination through a fair and impartial plebiscite under the auspices of the U.N. While India has systematically enacted laws, like Domicile Law to integrate Kashmir into India. These regulations, which violate 18 substantive United Nations resolutions on Kashmir that the Security Council has endorsed, are intended to alter Kashmir’s demographics. The root of the issue is India’s failure to carry out these resolutions calling for such a referendum, and have chosen the road of indiscriminate killing and intimidation rather than talks and a peaceful end to the dispute, the memorandum emphasizes.

According to the memorandum, the U.N. has the power to stop the violence and reverse this injustice. Keeping a simple log of cease-fire breaches between India and Pakistan is insufficient. Actually,¬ there have been more than 100,000 fatalities. The leader of Kashmir-freedom fighter, Mohammad Yasin Malik, is in a life-or-death crisis. Shabir Ahmed Shah has been incarcerated for 36 years. Including for MasaratAlam’s Public Safety Act (PSA) was quashed 35 times, but he is still in jail, and AasiaAndrabi was charged with PSA 20 times before being sent to Tihar Jail in India. KhurramParvez, who TIME lists as one of the top 100 influential people of 2022, has been charged under the Unlawful Activity Prevention Act. There are hundreds of political prisoners who need your help and immediate freedom in exchange for their unconditional release.

Therefore, United Nation must initiate a dialogue between India, Pakistan and Kashmiri people so that negotiation can be put forward. As, lasting peace in the region can be achieved only through comprehensive dialogue which is a primary aspect of UN Mandate.
