The Lahore High Court (LHC) on Thursday rejected a petition seeking removal of Punjab Governor Chaudhry Sarwar and declared it inadmissible for hearing.
It is worth mentioning here that Shahid Aurakzai had filed the petition and Justice Muzzamil Akhtar Shabbir heard it.
Assistant Advocate General Barrister Hassan Khalid Ranjha represented the Punjab government in the case to which the federal government was made the respondent through secretary Cabinet Division, principal secretary-II, Governor House and secretary law.
Shahid Aurakzai, the petitioner, had stated that contrary to the federal government’s policy, the Punjab government had announced a subsidy on the sugar export this year.
“Punjab Governor Chaudhry Sarwar failed to use his influence under Article-105 of the constitution to bar the Punjab government from doing this which was in violation of the Centre’s decision,” the petition read.
The petitioner further said that the governor did not even inform the federal government of the advantages of sugar export to Punjab.
“If Chaudhry Sarwar had intimated the federal government about the provincial government’s announcement of subsidy, sugar crisis could have been prevented,” he said, and prayed to the court that since the Punjab governor was not fulfilling his duties, he be removed from the post.
When Justice Muzzamil asked the petitioner under which clause of the constitution the governor was bound to intimate Centre about the provincial government’s violation of its policy, the latter replied that the matter was covered by Article-148.
