The Islamabad High Court on Monday rejected the application to declare the appointment of Member Election Commission Sindh Nisar Durrani invalid.
Pakistan Tehreek-e-Insaf leader Fawad Chaudhry had challenged the appointment of Member Election Commission Sindh.
According to the lawyers, the case of the Member Election Commission is slightly different and the court can exercise constitutional authority.
However, IHC Chief Justice Athar Minullah said the authority of the High Court is also according to the Constitution.
He said the constitution provides a forum for the removal of a member of the Election Commission from office.
The Chief Justice said the court exercises constitutional authority where there is no relevant forum.
The Chief Justice said the Prime Minister and the Leader of the Opposition consulted each other for the appointment of members of the Election Commission and if they don’t reach a consensus then the matter goes to the Parliamentary Committee.
However, Fawad Chaudhary’s lawyer said the appointment of Nisar Durrani is illegal.
Chief Justice questioned whether he was implementing that the parliamentary political parties made a wrong appointment.
The lawyer responded there may be a mistake and there may be something not known which will come to light later.
Upon this, the Chief Justice said if there is a mistake, then there is a forum to correct it.
