Court takes notice of faulty investigation

Islamabad—The Islamabad High Court has issued detailed order in bail matter of accused Zahid Iqbal while directing the police high ups to take exemplary action against the Investigation Officer (IO) who ignored the basic principles of investigation and tried to benefit the accused.
It may be mentioned that a case of rape and physical assault was registered against the accused Zahid Iqbal in Police Station Sihala on February 28 this year.
However, the accused was released on bail on the basis of poor evidence and faulty investigation by the police.
A petition was filed in the IHC against the bail of the accused and the court a day earlier dismissed his bail and asked the police to take him into custody and appoint a new Investigation Officer to probe the entire case from beginning. The accused was given benefit of doubt for the police could not produce any evidence from the crime scene.
However, Justice Noorul Haq N Qureshi taking notice of the matter and after hearing arguments from the victim’s counsel rejected the bail of the accused.
In his three-page order Justice Qureshi has expressed his surprise how an investigation officer can be so unprofessional not to collect the evidence at the crime scene. Neither the bed sheet nor tissue papers were collected from the crime scene, the decision reads. The judge has further pointed out that by weakening the case the IO Zulfiqar Ali has in a way tried to benefit the accused which is against his profession and job requirement.
The court has directed the officers concerned to withdraw him from investigation and appoint new IO in his place.
