Justice Mansoor Ali Shah also imposed fine of Rs100,000 and directed him to deposit the amount to the treasure of the court.
When hearing resumed, Director Finance Fayyaz Hussain admitted his guilt of impersonating himself as Dr. Ashfaq Ahmed Tunio, Chief Tax of FBR and thrown himself at the mercy of the court.
Some senior lawyers including Abdul Hafeez Peerzada, Shahid Pervez Jami and Khawaja Tariq Raheem while sitting in the courtroom also requested the court to accept his mercy plea and grant him pardon.
Rejecting the pleas of senior lawyers and unconditional apology of Fayyaz Hussain and convicted him for contempt of court under Section 5(1) of the ordinance and sentenced him to a punishment till the rising of the court.
The court order said that the action of the contemnor in impersonating as Chief Tax, PBR was a brazen display of deception in the face of the Court and amounted to diverting to the course of justice.
The action of the contemnor, therefore, constituted criminal contempt under Section 6(1)(c) of the Contempt of Count Ordinance, 2003, the court order added. The court also directed the ministry of interior to remove the name of the contemnor from the Exit Control List as the punishment had been served.
