Justice Dogar, other PCO judges issued contempt
notices
Islamabad—The Supreme Court on Friday issued
contempt of court notices to the apex court judges who took oath
under the Provisional Constitution Order (PCO) of November 3, 2007
in defiance to the restraint order passed by a seven-member bench of
the court.
A 14-member bench of the apex court headed by Chief Justice Iftikhar
Muhammad Chaudhry, issued the notices after amending the order the
court had passed on Oct 5, in which PCO judges of high courts were
issued contempt notices.
Chief Justice Iftikhar Muhammad Chaudhry observed, “In the order
dated 5-10-2009, directions have been made for issuance of notices
for contempt of Court to all the Judges who were Judges on 2-11-2007
or were appointed between 3-11-2007 and 15-12-2207 and violated the
order dated 3-11-2007 passed by the seven-member Bench, which
include the judges of the Supreme Court and the High Courts, but in
the commanding Para of the order dated 5-19-2009, due to typing
mistake, the words “judges of the Supreme Court” have not been
mentioned, therefore, the order dated 5-11-2009 is accordingly
rectified. Notices shall also be issued to the judges of the Supreme
Court n the same manner”.
Other members of the bench include Justice Javed Iqbal, Justice
Sardar Muhammad Raza Khan, Justice Khalilur Rehman Ramday, Justice
Mian Shikarullah Jan, Justice Tassaduq Hussain Jillani, Justice
Nasirul Mulk, Justice Raja Fayyaz Ahmed, Justice Ch. Ijaz Ahmed,
Justice Ghulam Rabbani, Justice Muhammad Sair Ali, Justice Muhammad
Akhtar Shahid Siddiqui, Justice Jawwad S. Khawaja and Justice Rahmat
Hussain Jafferi. It may be recalled that Supreme Court Office
pleaded Chief Justice Iftikhar Mohammad Chaudhry to clarify whether
the contempt of court notices will be issued only to High Court
Judges under 5th October 2009 ruling or the same notices should also
be issued to those judges of Supreme Court C who were working as
judges before 3rd November 2007 and they took oath under PCO,
violating the verdict of the 7-member bench of apex court ruled on
3rd November 2007.
The judges who have been served notices include Justice Abdul Hamid
Dogar, Justice Muhammad Nawaz Abbasi, Justice Saeed-ul-Shahed,
Justice Mosa K Laghari, Justice Ijaz Yousaf, Justice Ejaz-ul-Hasan
and Justice Qaim Jan Khan. Justice Fakir Muhammad Kokhar and Justice
M Javed Butter can also be affected by the decision.—NNI |
