SHC repeats notice to Secretary Interior, Foreign,
LEA’s
Karachi—A division bench of Sindh High Court Tuesday
repeated notices to Interior, Foreign Affairs Secretaties and
Directors of law enforcement agencies in a case filed against
handing over of five family members of petitioner to United States.
Petitioner, Ms Mariam sister of Khalid Sheikh Muhammad, an alleged
Al-Qaida activist, filed petition, sought recovery of her five
detained family members.
SHC earlier disposed off her petition observing its prayers as
anfractuous and allowed to file fresh one in accordance with
relevant provisions of law. Making respondents Fedration, through
Secretaries Interior, Foreign and directors of LEA’s she filed
another petition for procurement of her five family members Ramzi
Yousuf & Abdul Qadir son in law, Abu Musab alias Abdul Karim Mehmood,
nephew, Khalid Sheikh Muhammad, brother and Ammar alias Ali Abdul
Aziz, son.
All alleged detainees were arrested after September 11, 2001 terror
attacks in U.S., following crackdown over those having affiliations
with religious parties and groups by Pakistani agencies, she
submitted. The arrest of Ammar alias Ali Abdul Aziz and his handing
over to U.S. was confirmed by U.S. and Pakistani media on May 3,
2003.
Her counsel, Ghulam Qadir Jatoi contended it is responsibility of
LEA’s to intimate petitioner about arrest, whereabouts and reason of
arrest of her family members but they failed to do so. He argued
transfer of custody of detainees to U.S. authorities by Pakistan
government and their trial being Pakistani citizens by foreign
authorities, without proper opportunity of defence is illegal and in
violation of law.
He prayed to declare act of arresting and transferring detainees to
U.S. by Pakistani authorities as illegal and direct to procure their
custody from U.S. by approaching them officially or through UN and
produce them before court.
The division bench of SHC comprising Justice Mrs. Qaiser Iqbal and
Justice Syed Mehmood Alam Rizvi, finding notices un-served, repeated
notices to respondents and adjourned matter till date in office.—PPI
